Capacity Issues

Capacity matters are dealt with in the Court of Protection. This court has jurisdiction to make orders for persons who are deemed to lack capacity in the following areas:

Mental Health Tribunals

The Mental Health Tribunal is the Court which has the power to discharge and make recommendations for persons detained in hospital under a section of the Mental Health Act.

High Court Challenges

We are able to advise and represent clients challenging the decisions of local authorities or health authorities as to a lack of services and support. The team’s work particularly covers the inappropriate closures of care homes and the abrupt transfer of residents. This has included work for the Official Solicitor on behalf of incapacitated clients.

Section 117 Aftercare

Section 117 of the Mental Health Act enables certain categories of persons detained under the Mental Health Act to receive free aftercare on discharge from hospital. This can include accommodation as well as other services.
